S.90 (1) & (2) of the Police Act 1996 should cover it - it's member of police force opposed to constable:

"Any person who with intent to deceive impersonates a member of a police force or special constable, or makes any statement or does any act calculated falsely to suggest that he is such a member or constable, shall be guilty of an offence and liable on summary conviction to imprisonment for a term not exceeding six months or to a fine not exceeding level 5 on the standard scale, or to both."

"Any person who, not being a constable, wears any article of police uniform in circumstances where it gives him an appearance so nearly resembling that of a member of a police force as to be calculated to deceive shall be guilty of an offence and liable on summary conviction to a fine not exceeding level 3 on the standard scale."

The correct offence is under Section 46(3) of the Police Reform Act 2002.

46(3) Any person who, with intent to deceive-

(a) impersonates a designated person or an accredited person or an accredited inspector,
(b) makes any statement or does any act calculated falsely to suggest that he is a designated person, that he is an accredited person, or that he is an accredited inspector
© makes any statement or does any act calculated falsely to suggest that he has powers as a designated or accredited person or as an accredited inspector that exceed the powers he actually has,

is guilty of an offence and shall be liable, on summary conviction, to imprisonment for a term not exceeding six months or to a fine not exceeding level five on the standard scale, or to both.

because you're more likely to see a PCSO than a PC so it's an easier trick to pull?? **runs and ducks for cover** Posted Image

only joking before anybody throws their toys out the pushchair

on a more serious note, we had somebody in for doing just that, he was trying to travel stating he was a PCSO, obviously not know that we don't get automatic travel privileges and then couldn't produce any I.D anyway, mostly because he was lying, he said he didn't say he was a police officer because he didn't think people would believe him

I don't think a PCSO is a member of a police force so the above does not apply. I think Metplod has the relevant act and section.

PCSO's are a member of a police force, that's who employs me, i work from a police station under the supervision of a police sergeant, but PCSO's weren't around when the Police Act 1996 was made law so they had to make new laws about "Designated Persons" as stated above in the Police Reform Act

PCSOs are not members of a police force for the purposes of S.90 (1) & (2) of the Police Act 1996 that Yankee-Mobile mentioned earlier - only regular police officers fall within that category. If a PCSO decided to change into a regular officers uniform for the hell of it then they could be prosecuted for impersonating a member of a police force or special constable (if calculated to deceive etc etc).

As Giraffe said, 'member of a police force' means regular police officer.

I take it that could include an MOP who purchases a blank epaulette to go on a white shirt, and applies numbers to said epaulette that could be construed as impersonating a police officer? Or also pips or a crown?
