If you pulled a car over that had been doing this on the public highway what offences would you be thinking:

I'd be weary in regards to one of those cars! The red mist might descend on that individual if stopped ;)

Driving without due care for other motorists. As the smoke could blind other drivers causing them to crash.

or my fave. Using an emergency signal flare when there isn't an emergency.

Driving without due care and attention........all the smoke comes from the drivers side of the vehicles, therefore I'd be asking how they could possible devote all their concentration to driving whilst holding a flare/paint-spewing-device out the window....

Causing a danger to road users -Sec 22A RTA 1988

(1)A person is guilty of an offence if he intentionally and without lawful authority or reasonable cause
(a)causes anything to be on or over a road, or
(b)interferes with a motor vehicle, trailer or cycle, or
©interferes (directly or indirectly) with traffic equipment,
in such circumstances that it would be obvious to a reasonable person that to do so would be dangerous.


I'd argue the smoke is over the highway and a risk to other road users.

I've seen cars with that much smoke coming out of the windows, but it's usually ganja.
