To get someone off the street - breach of ASBO for example. I know that if someone breaches their asbo nothing is going to happen, but I arrest to put them before the court (and to get them off the street for the day and night)I agree, but all good police officers, must hold this thought in the back of their mind?!
NO it's not a requirement, but ask yourself....whats the point of making a successful/lawful arrest, when you know yourself it won't go to prosecution!?

Ooops, I'm sorry, I didn't realise the offence wording stipulated a minimum amount of electricity that had to be used, I thought it said 'any electricity'.

Well, the Theft Act defines what dishonesty isn't:
(a)if he appropriates the property in the belief that he has in law the right to deprive the other of it, on behalf of himself or of a third person; or
(b)if he appropriates the property in the belief that he would have the other’s consent if the other knew of the appropriation and the circumstances of it; or
©(except where the property came to him as trustee or personal representative) if he appropriates the property in the belief that the person to whom the property belongs cannot be discovered by taking reasonable steps
And it's wasted as it's not being used for the purpose it is intended (i.e. to cross the road).
NOTE: If I came across this I would not be arresting the person involved. I would be telling them to get a life. But for me the offence fits.
